Some of the factors that may affect a breath test include:

  • Gastroesophageal reflux disorder (GERD): During a breath test, people suffering from GERD can appear to have a higher blood alcohol concentration than they actually do. Alcohol regurgitated from the stomach may appear on the Breathalyzer reading, but because it has not entered the bloodstream it cannot contribute to impairment.
  • Breath temperature: Breath tests are based on an average human body temperature. If someone has an elevated temperature, such as from a fever, it can lead to an inaccurate reading.
  • Machine malfunctions: As with any machine, Breathalyzers can break down or malfunction. These breakdowns must be documented and can call into question the machine's accuracy.
  • Extrapolation: This can be used to help educate juries about possible estimations of blood alcohol content (BAC) based on the body's absorption/elimination of alcohol. This is especially helpful in cases involving a BAC that was lower at the time of driving than at the time of a later breath testing.
  • Carry-over: If someone takes a breath test multiple times, alcohol from previous tests can carry over and inflate the reading of subsequent tests.
