Driver's licenses are automatically suspended in Illinois, even for first-time DUI offenders, if:
- Breath or blood tests reveal blood alcohol concentration (BAC) of .08 or higher
- Blood tests reveal illegal drugs in the bloodstream
- You refuse to give a sample for any test
46 days after the arrest, the Illinois Secretary of State begins the suspension of your driver's license in almost all DUI cases. Consequences ranging from suspension (set time period for reinstatement) to revocation (no automatic reinstatement date) become more and more severe after the first offense.
A challenge of an automatic suspension is possible, but it must be filed within 90 days of the arrest.
