Subsequent DUI Consequences
For those facing a DUI repeat offense, the consequences are substantially harsher. Mandatory minimum jail sentences were added by the legislature for those with a second offense, even if the first offense did not yield a DUI conviction.
At Fombelle & Fombelle, LLP, we explain the consequences of a subsequent DUI and then put our years of experience to work as we prepare a comprehensive and aggressive defense for our clients in the Decatur area. Contact us to set up an initial consultation and see how we can use our experience and extensive trial skills to your benefit.
If a "non-first offender" refuses to take a breath, blood or urine test, his or her driver's license will be suspended for a minimum of three years, with no possibility of obtaining a driving permit.

Second DUI
- Mandatory minimum five days in jail (no day for day), or
- 240 hours of community service
- No supervision eligibility
- Mandatory additional two days jail if BAC is .16 or greater
- Felony eligible (class 2) if transporting child less than age 16
Third DUI
- Felony (Class 2)

Felony Charges
Many DUIs can be charged as felonies. Even a first or second offense can become a felony if you:
- Were driving without a valid driver's license
- Did not have insurance on the vehicle
- Are arrested for a DUI while your license was suspended or revoked
- Caused an accident that resulted in serious injuries or death
The severe consequences that can result from a felony DUI charge make it all the more important that you have an experienced DUI lawyer.
